This Article is about something federal courts of appeals have done for more than fifty years and more than 600 times. That something is reassignment, a practice where a reviewing court returns a case to a lower court for further proceedings while also directing that those proceedings be conducted by a different trial court judge. Drawing on an examination of the local rules and informal reassignment practices of every federal circuit and district in the United States, as well as an original dataset of 668 decisions in which reassignment was ordered, this Article represents the first scholarly examination of when reassignment happens, who orders it, and how it is ordered. More broadly, this Article uses reassignment as a means to explore the various ways that appellate courts might seek to control trial court judges and influence trial court outcomes. It also discusses what reassignment can teach us about notions of judicial impartiality and neutrality. Finally, this Article discusses reassignment’s implications for familiar debates about whether legal tests are better expressed through rules or standards and the extent to which it is desirable for judges to give reasons for their decisions.

What is a notice of assignment?

An assignment takes place when one party is holding a right to property, claims, bills, lease, etc., of another party and wishes to pass it along (or sell it) to a third party. As complicated as that sounds, it really isn’t. Strangely enough, many assignments can be made under the law without immediately informing, or obtaining the permission, of the personal obligated to perform under the contract. An example of this is when your mortgage is sold to another mortgage company. The original mortgage company may not inform you for several weeks, and they certainly aren’t going to ask your permission to make the sale.

If a person obligated to perform has received notice of the assignment and still insists on paying the initial assignor, the person will still be obligated to pay the new assignee according to the agreement. If the obligated party has not yet been informed of the assignment and pays the original note holder (assignor), the assignor is obligated to turn those funds over to the new assignee. But, what are the remedies if this doesn’t take place? Actually, the new assignee may find themselves in a difficult position if the assignor simply takes off with their funds or payment. They are limited to taking action against the person they bought the note from (assignor) and cannot hold the obligator liable. Therefore, it is important to remember that if any note or obligation is assigned to another party, each party should be well aware of their responsibilities in the transaction and uphold them according to the laws of their state. Assignment forms should be well thought out and written in a manner which prevents the failure of one party against another.

Why has my case been reassigned to another judge.

There are many reasons why a case is reassigned to a new judge–most of which involve the internal administration of the court. For instance, when a judge retires, passes away, or leaves the bench, the cases assigned to that judge must be reassigned to other District of Connecticut judges. In addition, when a new judge joins the bench, cases must be reassigned to the new judge. Furthermore, as part of the court’s general administrative functions, cases may be reassigned to different judges to equalize the caseload among the judges in the court.

Subpart i—reassignments, transfers, and details, § 317.901 reassignments..

( a ) In this section, reassignment means a permanent assignment to another SES position within the employing executive agency or military department. (See 5 U.S.C. 105 for a definition of “executive agency” and 5 U.S.C. 102 for a definition of “military department.”)

( b ) A career appointee may be reassigned to any SES position for which qualified in accordance with the following conditions:

( 1 ) Reassignment within a commuting area. For reassignment within a commuting area, the appointee must receive a written notice at least 15 days before the effective date of the reassignment. This notice requirement may be waived only when the appointee consents in writing.

( 2 ) Reassignment outside of a commuting area. For reassignment outside of a commuting area,

( i ) the agency must consult with the appointee on the reasons for, and the appointee's preferences with respect to, the proposed reassignment; and

( ii ) following such consultation, the agency must provide the appointee a written notice, including the reasons for the reassignment, at least 60 days before the effective date of the reassignment. This notice requirement may be waived only when the appointee consents in writing.

( c ) A career appointee may not be involuntarily reassigned within 120 days after the appointment of the head of an agency, or within 120 days after the appointment of the career appointee's most immediate supervisor who is a noncareer appointee and who has the authority to make an initial appraisal of the career appointee's performance under subpart C of part 430 of this chapter .

( 1 ) In this paragraph—

( i ) Head of an agency means the head of an executive or military department or the head of an independent establishment.

( ii ) Noncareer appointee includes an SES noncareer or limited appointee, an appointee in a position filled by Schedule C, or an appointee in an Executive Schedule or equivalent position that is not required to be filled competitively.

( 2 ) These restrictions do not apply to the involuntary reassignment of a career appointee under 5 U.S.C. 4314(b)(3) based on a final performance rating of “Unsatisfactory” that was issued before the appointment of a new agency head or a new noncareer supervisor as defined in paragraph (c)(1) of this section. If a moratorium is already underway at the time the final rating is issued, then that moratorium must be completed before the reassignment action can be effected.

( 3 ) A voluntary reassignment during the 120-day period is permitted, but the appointee must agree in writing before the reassignment.

( 4 ) For the purpose of calculating the 120-day period, any days, not to exceed a total of 60, during which the career appointee is serving on a detail or other temporary assignment apart from the appointee's regular position shall not be counted. Any days in excess of 60 days on one or more details or other temporary assignments shall be counted.

( 5 ) The prohibition in this paragraph on involuntary reassignments may be applied by an agency, at its discretion, in the case of a detail of an individual as the head of an agency or of a noncareer appointee as a supervisor, or when a noncareer appointee in a deputy position is acting as the agency head or in a vacant supervisory position. If the individual later receives a permanent appointment to the position without a break in service, the 120-day moratorium initiated by the permanent appointment shall include any days spent in the position on an acting basis.

( d ) A 15 or 60-day advance notice described in paragraph (b) of this section may be issued during the 120-day moratorium on the involuntary reassignment of a career appointee described in paragraph (c) of this section, but an involuntary reassignment may not be effected until the moratorium has ended.

§ 317.902 Transfers.

( a ) Definition. In this section, transfer means a permanent assignment or appointment to another SES position in a different executive agency or military department.

( b ) Requirements. Transfers are voluntary and cannot occur without the consent of the appointee and the gaining agency, except transfers connected with a transfer of functions to another agency.

§ 317.903 Details.

( a ) Definition. In this section, detail means the temporary assignment of an SES member to another position (within or outside of the SES) or the temporary assignment of a non-SES member to an SES position, with the expectation that the employee will return to the official position of record upon expiration of the detail. For purposes of pay and benefits, the employee continues to encumber the position from which detailed. The provisions of this section cover details within or outside of the employing agency.

( b ) Time limits.

( 1 ) Details within an executive agency or military department must be made in no more than 120-day increments.

( 2 ) An agency may not detail an SES employee to unclassified duties for more than 240 days.

( 3 ) An agency must use competitive procedures when detailing a non-SES employee to an SES position for more than 240 days unless the employee is eligible for a noncompetitive career SES appointment.

( 4 ) An agency must obtain OPM approval for a detail of more than 240 days if the detail is of:

( i ) A non-SES employee to an SES position that supervises other SES positions; or

( ii ) An SES employee to a position at the GS-15 or equivalent level or below.

( c ) SES career reserved positions. Only a career SES appointee or a career-type non-SES appointee may be detailed to a career reserved position.

( d ) SES general positions. Any SES appointee or non-SES appointee may be detailed to a general position.

§ 317.904 Change in type of SES appointment.

An agency may not require a career SES appointee to accept a noncareer or limited SES appointment as a condition of appointment to another SES position. If a career appointee elects to accept a noncareer or limited appointment, the voluntary nature of the action must be documented in writing before the effective date of the new appointment. A copy of such documentation must be retained permanently in the appointee's Official Personnel Folder.

The Supreme Court on Tuesday (August 27, 2024) sought the Gujarat government's response on former Indian Police Service (IPS) officer Sanjiv Bhatt's plea against his conviction in a 1990 custodial death case in which he was sentenced to life imprisonment.

"Issue notice returnable in four weeks," a bench of Justices Vikram Nath and Prasanna B Varale said. The court also tagged the appeal with other matters related to the case.

Bhatt has moved the top court challenging the Gujarat High Court's January 9, 2024 order dismissing his appeal. The court also upheld the conviction of Bhatt and co-accused Pravinsinh Zala under Sections 302 (murder), 323 (voluntarily causing hurt) and 506 (criminal intimidation) of the Indian Penal Code.

The high court had dismissed the State government's appeal seeking to enhance the sentences of five other accused who were acquitted of murder but convicted under Sections 323 and 506.

While Bhatt and Zala are behind bars, the court cancelled the bail bonds of the five other accused who are out of jail.

"We have also gone through the reasoning recorded by the trial court while convicting the concerned accused persons for offences punishable under section 302 of the IPC," the division bench said while reading out the order.

"From the evidence based on record, we are of the opinion that the trial court has rightly convicted (five) accused...for offences punishable under Sections 323," the judges had said.

Bhatt and Zala, both police officers, were convicted for murder by the sessions court in Jamnagar on June 20, 2019.

On October 30, 1990, then additional superintendent of police Bhatt detained around 150 people following a communal riot in Jamjodhpur town following a 'bandh' call against the halting of BJP leader L.K. Advani's 'rath yatra' for the construction of a Ram temple in Ayodhya.

Prabhudas Vaishnani, one of the detained persons, died in hospital after his release.

Vaishnani's brother accused Bhatt and six other police officials of torturing him in custody and causing his death.

Bhatt was arrested on September 5, 2018, in another case where he is accused of falsely implicating a man for drug possession. The trial in the case is underway.

He is also an accused in a case of alleged fabrication of evidence in connection with the 2002 Gujarat riots cases along with activist Teesta Setalvad and former Gujarat director general of police R.B. Sreekumar.

Bhatt had also hit the headlines when he filed an affidavit in the Supreme Court alleging then chief minister Narendra Modi's role in the 2002 Gujarat riots. The allegations were debunked by a special investigation team.

He was suspended from service in 2011 and sacked by the Ministry of Home Affairs in August 2015 for 'unauthorised absence'.

Orenburg Oblast ( Russian : Оренбургская область , romanized :   Orenburgskaya oblast' ) is a federal subject of Russia (an oblast ), mainly located in Eastern Europe . Its administrative center is the city of Orenburg . From 1938 to 1957, it bore the name Chkalov Oblast ( Russian : Чка́ловская о́бласть ) in honor of Valery Chkalov . Population: 1,862,767 ( 2021 Census ). [9]

Orenburg Oblast's internal borders are with the republics of Bashkortostan and Tatarstan to the north, Chelyabinsk Oblast to the north-east, and with Samara and Saratov oblasts to the west. Orenburg Oblast also shares an international border with Kazakhstan to the east and south. The oblast is situated on the boundary between Europe and Asia . The majority of its territory lies west of the continental divide in European Russia and smaller sections in the east situated on the Asian side of the divide. The most important river of the oblast is the Ural and the largest lake Shalkar-Yega-Kara . Orenburg is traversed by the northeasterly line of equal latitude and longitude. The highest point of the oblast is the 668   m (2,192   ft) -high Nakas . [10]

In the first half of the 18th century, the Russian Empire constructed the Irtysh line   [ ru ] , a series of forty-six forts, including Orenburg, [11] to prevent Kazakh and Dzungar nomads from raiding Russian territory. [12]

Orenburg played a major role in Pugachev's Rebellion (1773–1774), the largest peasant revolt in Russian history.

During the Russian Civil War , the region was heavily affected by the Russian famine of 1921–1922 .

During World War II , in 1941, the command and staff of the newly formed Polish Anders' Army was based in Buzuluk , [13] and in 1942, the First Czechoslovak Independent Field Battalion was based there. Both formations afterwards fought against Nazi Germany .

On 26 May 2024, a Ukrainian drone attacked the Voronezh M long-range radar station near Orsk . [14]

As of a 2012 survey, [23] 40.2% of the population of Orenburg Oblast adheres to the Russian Orthodox Church , 3% declare themselves to be generic nondenominational Christians (excluding the Protestant definition), 2% are Orthodox Christian believers who do not belong to any church or belong to non-Russian Orthodox churches . Muslims constitute 13% of the population. 3% of the population are followers of the Slavic native faith (Rodnovery), 6.8% are followers of other religions or did not give an answer to the survey. In addition, 20% of the population declares to be " spiritual but not religious " and 12% to be atheist . [23]

Orenburg Oblast is one of the major agricultural areas of Russia. Its climate is favorable to farming with a humid spring, dry summer and many sunny days, which make perfect conditions for cultivating hard wheat and rye , sunflowers , potatoes , peas , beans , corn , and gourds .

The range of the oblast's export commodities includes oil and oil products, gas and gas produced products, rolled ferrous and non-ferrous metals, nickel , asbestos , chromium compounds, rough copper, electric engines, and radiators, which are used to make products from the machine-building industry.
