‘Honour Killing’ is a cultural crime or a cultural tradition prevalent amongst non-Caucasian Societies which perceive women as bearers of family honour. Indian cultures are very deep rooted. Many young people in India have been done to death every year owing to ‘Honour Killings.’ It is because so called honour killings are based on the belief, deeply rooted in Indian cultures, which consider the women as objects and commodities, and not as human beings endowed with dignity and rights. Most honour killings occur in countries like India where the concept of women is considered as a vessel of the family reputation. This paper is an attempt to tackle the very important issue of a cultural crime that is magnifying day by day like a monster untamed. It is hard to believe that in the 21st century that too in the largest democracy of the world, families murder their kith and kin for allegedly saving their honour. But the question to be asked is this, is there any honour is killing? The concept of law that each man may do what he likes, provided he does not injure the equal freedom of others has been central to legal theory. As conditions of existence vary among different peoples and times, so do the principles of ethics and law. In any society there is a close connection between social morality and the legal order. There cannot be and there never has been a complete separation of law and morality. Historically ad ideological orders are observed into the legal order. And while in the traditional more or less custom bound society the flow was essentially in one direction the gradual transformation of social behaviour into legal custom and from custom into legislative prescription in the contemporary highly articulate and organized society, the law becomes in turn increasingly a major factor in the formation of social morality. However, there are times where the rule of law has been over ridden to give way to arbitrary and often violent actions by the society in order to preserve morality or honour of the clan. Every year around the world an increasing number of women are killed in the name of honour. Relatives, usually male, commit acts of violence against wives, sisters, daughters and mothers to reclaim their family honour from real or suspected actions that are perceived to have compromised it. Due to discriminator social beliefs and extremist views of gender, officials often condone or ignore the use of torture and brutality against women. As a result, the majority of so called honour killings so unreported and perpetrators face little, if any, consequence.

Honor killing, a repugnant practice stemming from perceived violations of cultural and societal norms, continues to be a prominent concern within India's legal framework. This dissertation conducts a thorough and analytical investigation of honour killings in India. The objective of this endeavour is to understand the complex interaction of socio-cultural, legal, and political factors that support this widespread phenomenon. The study utilizes a multidisciplinary approach, integrating sociological perspectives, legal examination, and human rights frameworks to elucidate the intricate dynamics inherent in honour killings. Moreover, the dissertation thoroughly explores the historical and cultural foundations that justify these transgressions, considering patriarchal structures, religion, and caste systems. Moreover, the study investigates the role of government institutions, specifically focusing on the difficulties faced by law enforcement agencies, the judiciary, and social service organizations in their efforts to effectively address honour killings. Highlighting the shortcomings in legal systems and the urgent need for legislative changes to improve safeguards for potential victims are issues of particular importance. This research provides a human-centred perspective by utilizing qualitative data sources such as interviews and case studies. The objective of this study is to shed light on the daily lives of victims and their families, with a focus on their experiences. The study also explores the ethical consequences of intervention strategies, as well as the potential role of non-governmental organizations, civil society, and community participation in challenging the existing norms. The main aim of this dissertation is to enhance the academic discussion on human rights, gender justice, and legal reform by thoroughly analysing the complex circumstances surrounding honour killings in India. The findings of this investigation provide valuable insights for policymakers, legal professionals, and scholars who are committed to eliminating this appalling violation of human dignity and promoting a societal focus on justice rather than outdated notions of honour.

Honour killing is a global phenomenon deeply rooted in cultural and societal norms. This research paper examines the complex issue of honour killings, analyzing the pattern, reasons, and legal frameworks of this crime with a particular emphasis on Indian and international legal frameworks. The word "honour" is often linked to limiting norms of society, especially when it comes to women's conduct and choices. This concept of honour is often associated with the concept of family pride and dignity. Honour killings may be committed against males as well, but women are more likely to be the victims. In India, the occurrence of honour killings is increased by the rigid patriarchal structures and caste system, which are further exacerbated by ineffective governmental measures. International legal frameworks such as the UDHR and the Convention on the Elimination of All Forms of Discrimination Against Women have attempted to combat gender-based violence including honour killings, however cultural tolerance and insufficient legal remedies have enabled the crimes to keep occurring. This research paper highlights the critical need for global gender equality advancement, comprehensive legislative action, public awareness, and international collaboration to tackle the issue of Honour Killings.

Abstract: newline Since the dawn of human evolution crime has been a perplexing problem. There is hardly any society which is without the danger of crime. The concept of crime is essentially apprehensive with the social order .A common sense of communal respect and faith for the rights of others regulates the demeanor of the members of the society interse. Though most people consider in peace and harmony, yet there are a few who digress from this normal behavioural pattern. This imposes a responsibility on the State to sustain normal situation in society, which is only achievable through the instrumentality of law. newlineThere has been an extensive increase in crime rate in recent phenomenon. This can be accredited to the changes in social standards brought about by the modernization and industrialization of the current society. The present era is highly a competitive society where people are struggling to survive by any means and hence often compelled to apply unfair means to lead a dignified life in lieu of inequitable method. So problem remains as problem and no power is able to curb this societal rigidity and narrowness and as a consequence, different social issues are cropping up diminishing the very concept of law and justice in the country. newlineIndia is a country where women are worshipped in the name of Goddess but at the same time torment and torture against women still today a blazing issue. Hardly a day passed where we can see in newspaper or in news channels women are in safe hands. Women form about half of the population of the country, but their situation has been grim. Before independence, women were prey to many abhorrent customs, traditional rigidities and vices. In our Indian society Honour Killing is taking place in the name of culture and tradition. From the concept of patriarchal dominance to present newlinevi newlinemasculine mentality the trend has been going on autonomously. Honour killing is increasing day by day. Twenty first century, known for guarantee of rights of each and every individual, has been facing a major crisis in the name of honour killing. The male dominant society has its deep root in the Indian caste system with its claim and target as women. History tells us that child marriage and denial of love marriage with an outsider, especially with a boy of low caste or community has been the result of retaining the family’s wealth within their family. Parents, instead of being well-wisher of their children voluntarily kill their daughter to avoid shame falling on their family. This paper highlights the problems associated with honour killing; and it brings out practical solutions to lessen this evil so as to secure women’s rights without deviating from tradition. Honor killings which are in contradiction with the fact that a woman as an individual is the only person to have a right on her own body/sexuality and which form a serious violation to her right to life continues to exist. The committed murders by the motive of honor conception whose definitional limits are not clear and out of which every person of the society, especially the men, make sense according to their own experiences are the most explicit indicators of violence against the woman. With the cases whose decisions are taken in Adana 3 rd Criminal Court, understanding of the relationship that exists between the individual environmental factors of honor-based killings committed by family members and the reasons behind such acts in various cultural contexts have been tried to put forward. Based on the fact that it is requisite to prevent such kind of killings for a country which take human rights as a reference to its legal and social practices, a variety of solution offers have been tried to be presented as they are thought to be effective in fight against honor killings.

India has attained a great advancement in every sphere of activity. Society has changed gradually with emerging socio-economic developments by adopting the pragmatic approach. Equal rights to the women vis-à-vis men are being ensured at every level in our progressive society. But, still very often we hear that young boys and girls are being killed in the wake of saving the honour of the family or society. Such incidents are reportedly increasing particularly in the northern region of the country. Honour killings are a blot on the society and it shows the feudalistic mindset of the perpetrators responsible for such killings. Every year, nearly 1000 young couples are being subjected to such killing in the name of honour. Mostly females are the victims of these killings, owing to the patriarchal structure of our society. These killings are against the constitutional provisions, which emphatically talks about equality, liberty and fraternity. The objective of the present paper is, therefore, to study and analyze the honour killings in India, which is tarnishing the image of Indian society. An attempt has been made to trace the history and examine the possible causes of these killings. The present study is doctrinal in nature and is based on secondary data gathered from various sources such as books, journals, reports etc.
